Peak Peptide Co — Website Terms and Purchase Agreement

Legal Business Name: Nexus Elite Ventures LLC, doing business as Peak Peptide Co (“PPC,” “we,” “us,” or “our”).
 

These Terms govern access to our website and purchases from Peak Peptide Co. Please read them before placing an order. By accepting these Terms at checkout, you agree to this purchase agreement. If purchasing for an organization, you represent that you have authority to act on its behalf.

 
1. Research Use Only

All products offered by PPC are intended exclusively for lawful laboratory research conducted by qualified personnel. PRODUCTS ARE NOT FOR HUMAN OR ANIMAL CONSUMPTION, INJECTION, OR APPLICATION.

Products are not offered for personal use, clinical trials, diagnostic procedures, therapeutic use, or the manufacture of products intended for administration to humans or animals. They are not sold as medicines, dietary supplements, foods, or cosmetics. No product is offered to diagnose, treat, cure, mitigate, or prevent disease.

 
2. Buyer Eligibility

To purchase from PPC, you must:

• Be at least 21.

• Have the training, facilities, and authority necessary to conduct lawful laboratory research, or purchase on behalf of an organization that does.

• Provide accurate billing, shipping, and contact information.

• Agree to use products only for the permitted research purposes described in these Terms.

We may request information to verify eligibility or intended use. We may decline or cancel an order if eligibility cannot be established or if we reasonably suspect prohibited use.

 
3. Buyer Responsibilities

You are responsible for evaluating whether a product is appropriate for your research and ensuring your activities comply with applicable laws. Products must be handled, stored, transported, and disposed of by trained personnel using appropriate laboratory procedures. You are responsible for reviewing available safety information, assessing hazards, providing protective equipment, and informing personnel of relevant risks. Purchasing a product does not establish that it is lawful or suitable for every proposed research activity.

 
4. Product Information and Testing

Product descriptions, images, and supporting documents provide information about the materials offered. Packaging may vary from website images. Where a Certificate of Analysis (“COA”) is provided, it reports the results and scope of the testing identified in that document. A COA does not establish safety for human or animal use, regulatory approval, sterility, or the absence of endotoxins unless the document expressly reports the applicable testing. No particular experimental result is guaranteed.

 
5. Orders, Pricing, and Payment

Prices are displayed in USD. Applicable taxes and shipping charges are disclosed before checkout. Payment must be authorized before fulfillment. An automated order confirmation acknowledges receipt of your order; it does not guarantee acceptance or shipment. We may decline or cancel orders because of unavailable inventory, suspected fraud, eligibility concerns, shipping restrictions, or material listing errors. If a paid order is canceled before fulfillment, we will refund the amount paid for the canceled portion. If we discover a material pricing error, we will contact you before fulfillment to obtain your agreement to the corrected price or cancel and refund the affected order.

 
6. Shipping and Delivery

Available shipping destinations, methods, and charges are disclosed at checkout or in our Shipping Policy.

Delivery estimates are estimates unless expressly guaranteed. You must provide a complete and accurate delivery address. For delayed, missing, damaged, or incorrectly fulfilled orders, contact PeakPeptideCoSupport@gmail.com with your order number and relevant details. We will investigate and provide an appropriate resolution consistent with our published policies and applicable law. Please review our Shipping Policy before ordering.

 
7. Cancellations, Returns, and Refunds

Cancellation requests should be submitted within 1 hour of purchasing a given product(s). We cannot guarantee cancellation after an hour has elapsed from the time of purchase. Returns, refunds, replacements, and reporting deadlines are governed by our Returns and Refunds Policy. That policy forms part of this agreement and should be reviewed before purchase. We do not accept returns. Eligible refund requests are handled under our Refund Policy, and no product should be shipped back to us. Nothing in these Terms limits rights or remedies that applicable law does not allow us to exclude.

 
8. Resale and Redistribution

Resale, repackaging, relabeling, or distribution to third parties requires prior written authorization from PPC.

Authorization does not permit prohibited use or relieve any party of its legal responsibilities. Products must not be represented as approved or suitable for human or animal administration.

 
9. Website Use and Intellectual Property

You may not use our website for fraud, unlawful transactions, unauthorized access, malicious software distribution, or interference with website operations. Content owned by PPC, including our branding, original text, and images, may not be reproduced or commercially distributed without permission, except as permitted by law. Third-party materials remain the property of their respective owners.

 
10. Informational Content

Website content and customer support communications provide general product and research information. They do not constitute medical advice or instructions for human or animal administration. Links to third-party websites are provided for convenience. PPC does not control or guarantee their content.

 
11. Disclaimer of Warranties

TO THE EXTENT PERMITTED BY LAW, PPC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PPC DOES NOT WARRANT THAT PRODUCTS WILL PRODUCE A SPECIFIC RESEARCH RESULT OR THAT WEBSITE ACCESS WILL BE UNINTERRUPTED OR ERROR-FREE.
 

These disclaimers do not override express product specifications, written commitments made by PPC, or warranties that applicable law does not permit us to exclude.

 
12. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, PPC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM WEBSITE USE OR PRODUCT PURCHASES.

To the extent legally permitted, PPC’s total liability for a claim concerning a product will not exceed the amount paid for the product giving rise to that claim. These limitations do not apply to fraud, willful misconduct, gross negligence, or liabilities that applicable law prohibits us from limiting.

 
13. Buyer Indemnification

To the extent permitted by law, you agree to indemnify PPC against third-party claims, damages, and reasonable expenses arising from your prohibited use of products, unlawful redistribution, or material breach of these Terms. This obligation does not apply to the extent a claim results from PPC’s own negligence, misconduct, or violation of law.

 
14. Privacy

Our Privacy Policy explains how we collect, use, and protect personal information. Acceptance of these Terms does not itself constitute consent to receive marketing emails or text messages. Any required marketing consent is collected separately.

 
15. Governing Law and Disputes

These Terms are governed by Tennessee law, without regard to conflict-of-law rules, except where mandatory applicable law requires otherwise. Please contact PeakPeptideCoSupport@gmail.com first so we can attempt to resolve a dispute. This request does not prevent either party from exercising available legal rights or meeting legal deadlines.

 

16. Changes and Severability

We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively. Orders remain governed by the version accepted when the order was placed unless otherwise agreed or required by law. If a provision is unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
